1. Furniture & Personal Belongings
   • Unless included in writing, all furniture, personal belongings, electronics, artwork, valuables, and breakables must be removed prior to installation.
   • Pianos, pool tables, safes, aquariums, oversized items, and specialty appliances must be removed by qualified professionals.
   • El Niño Floors is not responsible for damage to items left in or near the work area.
2. Moisture, Humidity & Site Conditions
   • El Niño Floors is a flooring retailer and installer and is not a moisture remediation company, engineering firm, environmental consultant, leak detection specialist, mold remediation company, or building inspector.
   • Any observations made by El Niño Floors regarding moisture, humidity, leaks, subfloor conditions, or site conditions are visual observations only and do not constitute a professional inspection, certification, warranty, or guarantee.
   • It is the sole responsibility of the homeowner, builder, contractor, remediation company, and/or property owner to ensure the site is suitable for flooring installation.
   • El Niño Floors shall not be liable for damages, failures, mold, mildew, odors, swelling, buckling, lifting, warping, staining, moisture transmission, hydrostatic pressure, leaks, foundation issues, humidity issues, or environmental conditions existing before, during, or after installation.
   • Manufacturer humidity and environmental requirements must be maintained before, during, and after installation. Failure to maintain proper conditions may void product warranties.
3. Appliances & Plumbing
   • Disconnecting and reconnecting appliances, gas lines, water lines, toilets, and plumbing fixtures is the homeowner's responsibility unless otherwise agreed in writing.
   • El Niño Floors is not responsible for leaks, plumbing failures, appliance malfunctions, or related damages.
4. Paint, Walls & Finishes
   • Scuffs, scratches, dents, marks, and paint touch-ups are a normal part of renovation work and are not considered damage.
5. Carpet Seams
   • Carpet seams are normal and may be visible depending on the product, lighting, and room conditions. Invisible seams cannot be guaranteed.
6. Subfloor Conditions, Hidden Conditions & Hazardous Materials
   • Pricing is based on visible site conditions only.
   • Hidden conditions discovered before, during, or after demolition, including moisture, mold, asbestos, lead paint, structural deficiencies, damaged subfloors, uneven surfaces, or unsuitable substrates, may require additional labour and materials.
   • El Niño Floors does not test for, identify, remove, or remediate asbestos, mold, lead paint, hazardous materials, or environmental contaminants.
   • If hazardous materials or unsafe conditions are discovered, work may be suspended until corrected by qualified professionals at the Client's expense.
   • Any estimates for subfloor preparation, leveling, moisture-related work, or repairs are based on visible conditions only and may be revised once demolition and full site exposure have occurred. Any additional labour, materials, or repairs required will be added to the final invoice.
7. Glass, Mirrored, Sliding & Specialty Doors
   • Some doors may not be removable or re-installable due to design, weight, hardware, site conditions, or risk of damage.
   • Floor height changes may affect door operation and clearance.
   • Door modifications, trimming, reframing, hardware adjustments, glass work, and replacements are excluded unless specifically quoted.
   • El Niño Floors is not responsible for door damage, breakage, fitment issues, or pre-existing defects.
8. Dust & Cleaning
   • Flooring installation and renovation work generate dust.
   • Additional cleaning, duct cleaning, or HVAC servicing may be required and are not included unless specifically quoted..
9. Quotes, Deposits & Materials
   • Quotes are valid for 14 days unless otherwise stated.
   • Material availability and pricing are subject to supplier inventory, freight, tariffs, taxes, and manufacturer pricing.
   • Deposits are required to secure materials and installation dates and are non-refundable once materials have been ordered, allocated, shipped, cut, custom-made, or specially ordered.
10. Returns & Exchanges
    • Carpet, transitions, special orders, custom orders, discontinued products, installed products, and selected manufacturers' products are final sale.
    • Approved returns are subject to a minimum 25% restocking fee and must be returned within 14 days in original unopened packaging.
11. Deliveries
    • Cash & Carry deliveries are limited to garage, driveway, or curbside delivery unless otherwise specified.
12. Late Payments
    • Overdue balances will be charged interest at 2% per month (24% annually).
    • The Client agrees to pay reasonable collection, legal, and court costs incurred in recovering overdue amounts.
